Kinvestor provides a financial data and analytics platform offering market news, index quotes, stock movers, and related market intelligence. The Services are intended for informational and educational purposes only. We reserve the right to modify, suspend, or discontinue any part of the Services at any time without notice.

3. Informational Purposes Only; No Financial Advice

The content provided through the Services, including but not limited to market data, news, analysis, and opinions, is for informational purposes only. Nothing contained on the platform constitutes investment, financial, legal, or tax advice. Kinvestor is not a registered investment advisor, broker-dealer, or financial planner. You should consult with a qualified financial professional before making any investment decisions. Trading and investing in financial markets involves substantial risk.

User Responsibility & Data Accuracy: Market data provided on Kinvestor may be delayed as specified by financial exchanges or data providers. We do not verify data, and we do not guarantee its accuracy, completeness, or timeliness. By using the Services, you agree that you are solely responsible for your own investment research and decisions, and you agree to verify all data, quotes, and market information independently before executing any trades or investments. Kinvestor is not liable for any financial losses or damages incurred based on the information provided on our platform.

4. User Accounts and Security

To access certain features, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. We will not be liable for any loss or damage arising from your failure to protect your account information.

5. Intellectual Property Rights

All intellectual property rights in the Services, including but not limited to text, graphics, logos, software, and data structures, are owned by or licensed to Kinvestor. You are granted a limited, non-exclusive, non-transferable license to access and use the Services for your personal or internal business use. You may not copy, reproduce, distribute, reverse-engineer, or create derivative works from the Services without our express written permission.

6. Data Providers and Third-Party Content

Kinvestor aggregates data from various third-party providers (e.g., Polygon.io, Finnhub). While we strive to provide accurate and timely information, we do not guarantee the accuracy, completeness, or reliability of any third-party data. You acknowledge that reliance on any such data is at your own risk.

7. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Kinvestor, its affiliates, directors, employees, or agents be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or relating to your use of, or inability to use, the Services. Our total liability to you for all claims arising out of these Terms shall not exceed the amount you paid us for the Services during the twelve (12) months preceding the claim.

8. Indemnification

You agree to defend, indemnify, and hold harmless Kinvestor and its affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Services; (ii) your violation of any term of these Terms; or (iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right.

9. Dispute Resolution: Arbitration Agreement and Class Action Waiver

Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court. You and Kinvestor agree that any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, or to the use of the Services, will be settled by binding arbitration, rather than in a court of general jurisdiction. You further agree that any arbitration will take place on an individual basis; class arbitrations and class actions are not permitted, and you are agreeing to give up the ability to participate in a class action.

10. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law principles. Subject to the arbitration agreement above, you agree to submit to the personal and exclusive jurisdiction of the state and federal courts located in Ohio for the resolution of any disputes arising out of these Terms.
